At the Ika-21 Association, at the Irakli Kemoklidze Day Center, young lawyers, criminal law specialists Mariam Gaboshvili and Tsitsi Tevzadze, conducted a training for disabled youth on the topic of \u201cMan and the Law\u201d. Disabled youth were provided with information about the Constitution of Georgia, the rights of disabled people, what a criminal offense means, explained the forms of crime, and what kind of prohibitions there are under Georgian legislation.<\/p>

Disability status does not give a person the right to break the law!<\/p>

It is true that disabled people are not exempt from criminal liability just because of their status. However, criminal law and judicial practice take into account their situation and special needs both in terms of liability and in determining punishment.<\/p>

Basis of criminal liability:<\/p>

In criminal law, a person is liable if he committed a crime intentionally or negligently, and at the time of this act was sane (capable of acting).<\/p>

Disability status does not mean that a person is automatically incapacitated. A decision on capacity must be made on the basis of a psychological and psychiatric examination.<\/p>

Capacity and mental health:<\/p>

If a person was unable to understand his actions or control them due to a mental disorder, he may be considered incapacitated and released from liability.<\/p>

In such a case, compulsory medical measures may be prescribed for the person.<\/p>

Sentencing Consideration:<\/p>

Courts take into account the situation and needs of a person with a disability when determining a sentence.<\/p>

In some cases, disability may be a basis for mitigating the sentence.<\/p>

Social Rights and Equality:<\/p>

Persons with disabilities, like all other citizens, are equal before the law.<\/p>

Their rights are protected by international conventions (e.g., the Convention on the Rights of Persons with Disabilities, CRPD) and national legislation.<\/p>
